A patent protects how something works or, in the case of a design patent, how something looks. For a device to be protected by a utility patent, the device must have utility or some usefulness. A copyright protects works of art. You may be able to get a patent that adds features or builds on somebody else’s idea, so long as what you have added is patentable.
